Terms of Service for Kizmo Kids

1. Acceptance of Terms & Parental Responsibility

By downloading, installing, or allowing your child to use Kizmo Kids, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and that you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, please do not install or use the application.

2. Educational Nature & Content Disclaimer

Kizmo Kids is designed as a playful, supportive early childhood educational resource covering alphabet phonics, basic counting, arithmetic concepts, shapes, colors, animal recognition, and good habits.

3. License & Permitted Use

We grant you a non-exclusive, non-transferable, revocable, personal, family-use license to install and use Kizmo Kids on compatible Android mobile devices that you own or control.

You agree that you will not:

• Reverse engineer, decompile, or disassemble any portion of the application codebase or assets.
• Copy, redistribute, sell, rent, or lease any artwork, character designs, audio recordings, or nursery rhymes.
• Attempt to bypass or circumvent the adult mental math parental gate.
• Use the app for commercial daycare broadcasting or public broadcast without prior written consent from RG Infotech Solutions.

4. Parental Controls & Healthy Screen-Time Guidance

We provide positive screen-time reminders and friendly break suggestions inside the Parent Area. You acknowledge and agree that:

• Parents and legal guardians are solely responsible for managing the total screen time of their children.
• Kizmo Kids does not implement punitive device-level lockouts or anxious countdown clocks that disrupt healthy emotional regulation.
• Access to adult settings and in-app subscription management is protected by a mental math challenge which you must supervise.

5. In-App Purchases & Kizmo Kids Premium Subscriptions

Kizmo Kids is 100% ad-free for all users, providing a comprehensive free foundational curriculum and an optional subscription service (Kizmo Kids Premium) for unlimited creativity sheets, expanded story packs, and multi-child family profile support.

• Parent-Gated Purchasing: Subscriptions can only be initiated from inside the adult Parent Area behind the mental math challenge.
• Google Play Billing: All purchase transactions are processed directly and securely by Google Play. We do not store or process your payment card information.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless canceled by you at least 24 hours before the end of the current billing period.
• Cancellation & Refunds: You can manage or cancel your subscription at any time directly through Google Play Store (Google Play → Profile icon → Payments & subscriptions → Subscriptions). Refund requests are subject to Google Play refund policies.

6. User-Generated Artwork & Local Storage

Kizmo Kids includes a Creativity Studio featuring digital drawing canvases, coloring sheets, and sticker scenes:

• All drawings, paintings, and sticker compositions created by your child belong exclusively to your family.
• Artwork is stored solely on your local device memory and is never uploaded, analyzed, or shared to any external server.

7. 100% Ad-Free Commitment

Kizmo Kids is completely free of commercial advertisements:

• No Commercial Advertisements: We do not display banner advertisements, interstitial popups, video commercials, or sponsored promotions anywhere in the app.
• No Google AdMob or Third-Party Ad SDKs: No third-party advertising SDKs are embedded in the software.
• Distraction-Free Learning: Children can explore, play, trace, and read without commercial interruption or accidental ad clicks.
• Zero Advertising Tracking: We never collect, track, or share advertising identifiers (such as Google Advertising ID / GAID).

8. Intellectual Property Rights

All intellectual property rights in Kizmo Kids—including the app name, logos, character mascots, voice recordings, sound effects, original stories, educational curricula, and graphics—are owned exclusively by RG Infotech Solutions. All rights are reserved.

9. Disclaimer of Warranties & Limitation of Liability

Kizmo Kids is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, RG Infotech Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the application.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Gujarat, India.
